TERMS OF USE


By using the services provided by Diabro.net you are agreeing to our rules and our terms as outlined in detail in our policy section. It is of great importance that all visitors, customers and potential customers read these policies carefully before registration or placing an order.

It is the responsibility of the user of the services provided by Diabro.net to view and understand the policies and terms of which they are subject. Policies will change and be updated and it is likewise the responsibility of the user to remain familiar with them.

All information given to Diabro.net by our registered users will not be shared, distributed or sold to any third parties.

Any contract entered into as a result of a purchase on Diabro.net or any dispute arising from a purchase on this site will be subject to the jurisdiction and laws of Japan.

We encourage all our customers to take great care choosing items and placing orders with us. Please always refer to the size charts when choosing sizes. If you do not understand the measurements provided or you have further enquiries regarding product or our shipping policy, please do not hesitate to contact us.

Once you have decided on your purchase, please proceed and place your order through our website. Please note that we do not accept any phone orders and can not accept any credit card payment over the telephone or via email.

When we receive an order we will confirm the availability and email and/or telephone regarding payment verification and delivery. In the event that the item ordered is unavailable or does not meet our strict quality control checks, we will email you suggesting possible replacements. We will wait 24 hours, however if we do not hear from you within this time we will proceed and refund your full payment.

Once we have confirmed the order and payment, we will organise to dispatch this and email you with your delivery confirmation and your online tracking number.

Although we try to maintain updated and accurate information on our website, we do regret that in the rare situation human and technical errors may result in the mis-representation of product information, availability and or pricing. We reserve the right to correct and update any information on our website prior to, or after an order has been placed. Unfortunately if information related to a product purchased is deemed to be incorrect the order may be cancelled without any prior warning and the full payment refunded. We sincerely apologise for any inconvenience this may cause.

Please also note that Diabro makes every effort to ensure that the colours of merchandise as represented on our website are as accurate as possible. However, colours may vary depending on each individual monitor that the website is viewed on and Diabro can not guarantee that colours of merchandise will be accurately portrayed on every monitor.

All photos of merchandise displayed on our website are taken specifically for Diabro Inc. These images can not be used for any purposes without written consent from Diabro Inc.


PAYMENT POLICY


Diabro accepts payments made by:

  • Bank Transfer

  • Credit Card

  • Paypal


BANK TRANSFER
The safest and most secure type of transaction. A bank transfer payment is a direct deposit from your bank account to ours.

After selecting the bank transfer option at the checkout, you will then be requested to send a confirmation email confirming your ability to finalise the bank transfer payment. Diabro.net will not hold any merchandise for Bank Transfer purchases until this confirmation has been received. Unfortunately, we will not be held responsible for any inconvenience caused if any item sells out prior to receiving the confirmation email.

We will then contact you to confirm the availability of the selected merchandise and also to provide you with all of the necessary information to finalise the bank transfer. You will then be required to make the bank transfer within 48 hours and confirm this with us by email supplying us with transaction receipt numbers in order to assist us in identifying your payment in our account. Please note that any transfers that are made anonymously may not be recognised in our account. Orders that have not been confirmed within 48 hours are subject to cancellation.

We must receive the full order total into our account in US Dollars. Customers must also cover any international transfer fees charged by their own banks and any intermediary banks that may be used. We are unfortunately unable to advise of these fees so please enquire at your bank when making the deposit.

Please note that it can take up to 5 business days for international bank transfers to clear into our account. Once the funds have cleared, we will proceed to complete and ship your order.

PAYPAL
Diabro.net accepts direct credit card payments through www.paypal.com . For customers who have a Verified Paypal account with a "Confirmed" address, orders can be processed and dispatched within 24 hours of placing the order. A Verified Paypal payment can assist in speeding up the order process. Paypal payments via an Unverified and Unconfirmed account can take at least 48 hours to process. Please note that we are only able to ship to the same name and address as listed in your Paypal payment. For more information, please visit www.paypal.com

GOOGLE CHECKOUT
Diabro.net also accepts direct credit card payments through Google Checkout. Detailed information about this service is available at the Google Checkout website http://checkout.google.com

As an overview, when selecting the Credit Card payment option at the Diabro.net checkout you will be re-directed to the Google Checkout page. If it is your first time to use the Google Checkout service you will be required to register an account with Google before the transaction can be completed. This process is very simple and is something that only needs to be done once. Returning customers are able to log in to their Google account automatically upon their next visit.

GENERAL INFORMATION REGARDING CREDIT CARD PAYMENTS
All first time customers to Diabro.net will be subject to the fraud detection verification procedures of our Fraud Prevention and Security Officers. This means that you may have to speak to a Diabro.net representative on the telephone in order to confirm your address, contact details and any other relevant personal information. For this reason, it is very important that you provide Paypal or Google Checkout and Diabro.net with the correct personal information. Should it happen that we are unable to contact you within 24 hours your order may be cancelled.

It may be required that the credit card holder provides Diabro.net with a legitimate form of identification. Currently, only passports, national identification cards and driving licenses will be accepted. You may also be required to provide proof of address by supplying us with a copy of either a current bank statement, telephone bill or utility bill. This information can be scanned or digitally photographed and e-mailed to info@diabro.net.

Diabro.net requires all copies of legal identification sent to us be in full colour, clear and legible. We can not accept blurry or illegible copies of the requested documents. To ensure that your order is processed as quickly as possible, please be prepared to send clear and legible documentation when placing your first order with Diabro.net . If we do not receive the requested documents within 48 hours, your order may be cancelled.

Finally, it is also required that when registering a Diabro.net account that you input your correct date of birth, as our Fraud Prevention Team may use this information as an integral part of their security check. All personal information is kept strictly confidential and will not be distributed to third-parties or used for any other purpose than to verify your account and payment details. All personal information and documents received will be destroyed upon inspection and completion of the order.

Diabro.net reserves the right to refuse any orders that we believe to be suspicious, even after we have received this information. Should instances of fraud occur after these security measures have been enforced, Diabro.net reserves the right to use all personal information that we have acquired to initiate legal procedures against those involved in criminal activity.


SHIPPING POLICY


Diabro uses EMS (Express Mail Service) when shipping orders. This is the fastest regular international express postal service available. As EMS has offices in most countries it is very fast, affordable and secure as we insure all packages at no extra charge. On completion of an order our customers receive an EMS tracking number which can be used to follow the progress of their parcels online (http://tracking.post.japanpost.jp/service/jsp/refi/DP311-00100.jsp?locale=en). Please allow 36 hours for this service to become available.

EMS costs are determined by both the weight of goods and their destination. Therefore rates will vary depending on specific items. Shipping and handling costs will be automatically added to your order total at the checkout.

The average delivery time for most destinations is between 3 and 6 business days. While delays are uncommon, on occasion there can be delays of up to a few weeks. In this instance, as we are not the receiver, we are unable to assist and customers must contact their local EMS or postal service for details.

Diabro.net upholds all international shipping regulations regarding product declaration and value, and therefore will not be held responsible for any additional customs taxes incurred on delivery.

EMS parcels must be signed for on delivery, in the instance that no-one is at the specified address to receive the parcel, a slip will be left that indicates an attempted delivery and the parcel must then be picked up in person by the customer. It is the responsibility of the customer to enquire about the amount of time their local post office will hold an unclaimed parcel before returning it to sender. We will not cover re-shipping costs and must recover this amount before we will send the order again.

ADDITIONAL SHIPPING SERVICES
There can be an increased risk of delays in delivery time when shipping to countries that do not have internal EMS offices. Parcels are then handed over to the local postal services. Customers from some Middle Eastern countries for example have elected alternative shipping companies such as FedEx or UPS. We are more than happy to arrange to ship orders with companies other than EMS provided all additional costs are covered by the customer.


RETURNS AND EXCHANGES POLICY


All returns and exchanges are only possible on prior agreement with Diabro when we are contacted within 24 hours of the order being delivered. We will then confirm this request via email supplying details on how to execute the return. We must then have the returned items back within the next 7 days.

Our authorization of a return does not guarantee we will proceed with an exchange, store credit or refund. All returned items must undergo quality inspections before we finalize the agreement. The item must be unworn with all original tags attached and in any original packaging supplied.

We do not cover shipping costs for returns or exchanges unless otherwise agreed upon.

We must receive the returned merchandise and recover re-shipping costs plus any difference in price before shipping replacement goods or issuing a store credit or refund.

DIABRO STORE CREDIT
Diabro store credit is available for customers on prior agreement with us. The value agreed upon is connected to your personal Diabro account for use on future purchases and will not expire until it is redeemed by the Diabro account holder. When we issue store credit you will be sent an email with instructions on how you can redeem it for your next Diabro purchase.

HOW TO RETURN
Customers who have read the above guidelines and wish to proceed with a return must immediately contact us at info@diabro.net on the same day the order is delivered. Please also indicate any desired replacement items as soon as possible or indicate you wish to receive a store credit or refund. If you believe you have received faulty items please also include clear photographs in your email.

We will contact you with our reply within the next 12 hours at which time we will supply you with our return address and all instructions we require for the re-shipping. Please also note that it is the customer's responsibility to cover all return shipping expenses and Diabro.net will not reimburse these costs.

Once we have inspected the returned merchandise you will be contacted with more information.
